Terms & Conditions
1.1 Please read these terms and conditions (these “Terms and Conditions") before entering the contest. This is a legally binding agreement between you and Samuel Smith & Son Pty Ltd. establishing the terms and conditions under which you are entitled to participate in the contest. By entering the contest, you confirm that you have read and understood, and agree to abide by these terms and conditions.

3.1 This contest is open to participants aged 18 years and above, who are residents of Australia only. All entries must be submitted within the contest period. Entries submitted outside of the contest period will be disqualified from the contest.
4. Not eligible
4.1 The following are not eligible to participate in the contest: 4.1.1 Any employee (and the immediate families of any employee) of the Organiser, or of the agencies or companies or any retailers associated with this competition.
5. Contest period
5.1 The promotion commences Wednesday, 7th October 2020 at 5PM (AEDT) and closes Wednesday, 28th October 2020 at 5PM (AEDT).
6. Contest ownership
6.1 All entries become the property of the Organiser. Entries must be original material created by the participant. Entries that contain content not originally created by the participant (as determined by the Organiser in their sole discretion) shall be disqualified from the contest.
6.2 By entering this competition, entrants agree that the Organiser is the sole and exclusive owner of the entry.
7. Entry method
7.1 This is a game of skill. Chance plays no part in determining the winner. During the competition period, entrants must: 7.1 .1 Submit an answer to this question in 25 words or less: What's your favourite summer tradition? 7.1.2 Submit the entry as a comment on the relevant and corresponding Jansz Tasmania post, located here Facebook or Instagram. 7.1.3 The best and most creative submission, as judged by the Organiser in their sole discretion, will win. A participant is able to submit multiple entries, however is only eligible to win one prize under this contest. How prize winners will be selected 7.1.4 Entries will be judged on creative merit and general appeal by the Organiser. 7.1.5 The Organiser reserves the right to select another prize winner if an original prize winner is subsequently disqualified from the contest or fails to claim a prize by Friday, 6th November, 2020.
There will be five winners selected at the conclusion of the contest period. The winners will receive:

9. How the prize winner will be notified
9.1 The Organiser (or its agency representative) will respond to the winner’s Facebook or Instagram comment with a request to send Jansz Tasmania a private message on Facebook or Instagram. The winner must supply Jansz Tasmania with a scanned copy of the winner’s ID, as well as the winner’s physical residential or office address, at which the winner will accept delivery of the prize.
Failure to produce a valid and current ID will disqualify the winner from receiving the prize.
9.2 The Organiser will contact the winner no later than Monday, 2nd November, 2020.
10. Claiming a prize
10.1 The prize will be sent out to the winner’s nominated delivery address (residential or office address), once confirmed by the winner via private message. The Organiser is not responsible for loss or damage of prizes. The Organiser is not responsible if the winner provides an incorrect email address.
11. Entry forms
11.1 The Organiser is not responsible for printing or typographical errors in any contest-related materials or for registrations, entry forms or submissions that are incomplete, lost or misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including electronic, computer, telephone, paper transfer, mail system, human or other error; including inability to access any website associated with the contest. Proof of online submission shall not constitute proof of receipt by the Organiser. If any information provided on an entry form is found to be misleading or inaccurate, that entry shall be deemed invalid.
12. Goods as prizes
12.1 Where the prizes under the contest are items/goods, these shall be subject to availability and may not be substituted for cash. The Organiser reserves the right to vary or offer an alternative prize of equivalent monetary value, without giving any reason or prior notice. The prize is non-exchangeable and non-refundable.
13. Other costs
13.1 Taxes and other levies imposed by any relevant applicable government or tax authority, as well as other costs including insurance and incidental costs, that may be levied or incurred on the prize shall be fully borne by the prize winner(s).
14. Your submission's fitness for publication
14.1 By entering the contest, you expressly agree that your entry ("submission") does not contain any text, image or content that is unlawful, libellous, slanderous, defamatory, includes children or minors, or invasive of another person's right of privacy or right of publicity, or that the Organiser may reasonably deem harmful, infringing of other's intellectual property rights, vulgar, obscene, derogatory, sexually inappropriate, pornographic, abusive, harassing, violent, threatening, hateful, objectionable with respect to race, religion, creed, national origin or gender, or otherwise unfit for publication. The Organiser shall not be liable in anyway for any submission. The Organiser shall have no obligation to monitor your submission, but may do so at its discretion. If, the Organiser, in their sole and absolute discretion, consider your submission inappropriate or unsuitable for publication, the Organiser may remove your submission from the contest.
14.2 Representations and warranties relating to your entry You represent and warrant to the Organiser that (I) you are the sole and exclusive owner of your entry, or you have all right and authority to grant the rights in your entry to the Organiser, its affiliates and/or its agents and contractors. Promotional activities
14.3 You agree to have your name and photo used for promotional purposes at the Organiser’s discretion. If you are a prize winner, except where prohibited by law, you consent to the use of your name, photo and/or likeness, biographical information, winning entry, submissions(s) and statements attributed to you (if true) for advertising and promotional purposes without any compensation or notice you.
14.4 The Organiser reserves the right to request winners to provide proof of identity and proof of residency at the nominated prize delivery address. Identification considered suitable for verification is at the discretion of the Organiser. Failure to comply with this term will disqualify the winner from receiving the prize.
15. The Organiser’s rights in your submission:
15.1 You grant to the Organiser and/or their affiliates a non-exclusive, fully transferable, perpetual, irrevocable, royalty free, fully paid-up right and license: 15.1.1 to adapt, edit, modify, publish, promote, reproduce, distribute, publicly display your entry and make derivative works based on it in any and all media, including any compilation, as the Organiser and/or their affiliates see fit for any reason, 15.1.2 to identify you as the author of the entry, and 15.1.3 to authorise others to do any of the things described above without any obligation to notify or compensate you. Without limiting the generality of the provisions above, the Organiser and/or any of its affiliates shall have an exclusive right to publish and use any winning entry(ies) in print and/or electronic form for advertising and promotion of the Organiser’s products, for exhibition, and for both commercial and non-commercial products and publications, including without limitation, using, downloading, adapting, reformatting, editing and/or resizing the winning entry(ies) as may be necessary and to authorise others to do any of the above without any obligation to notify or compensate the prize winner(s).
16. Limitation of liability; indemnity:
16.1 Nothing in these Terms and Conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act, as well as any other implied warranties under the ASIC Act or similar consumer protection laws in the States and Territories of Australia. To the maximum extent permitted by law and except for any liability that cannot by law be excluded, the Organiser and their affiliates, related corporations, subsidiaries, directors, officers, employees and agents accept no responsibility and shall have no liability whatsoever for any claim, damage, loss, expense, death or personal injury arising out of or in connection with (a) your participation in the contest, and/or (b) if you are a prize winner, the use of the prize. You undertake to indemnify and keep the Organiser and their affiliates, related corporations, subsidiaries, directors, officers, employees and agents harmless and indemnified against any loss, damage, claims, costs and expenses which may be incurred or suffered by any or each of them arising out of or in connection with your breach of any of these terms and conditions and/or your participation in the contest.
17. The Organiser’s decision is final and binding
17.1 All matters and disputes arising out of or in connection with the contest and/or these terms and conditions shall be subject to the sole decision of the Organiser and the Organiser’s decision shall be final and binding on all parties. No correspondence will be entertained.
18.2 No cheating tolerated
18.3 You acknowledge and agree that no form of cheating will be tolerated. If you are found cheating, as determined in the sole and absolute discretion of the Organiser, you will immediately be disqualified from the contest. Cheating includes, but is not limited to, using multiple Facebook or Instagram profiles, tampering with, hacking of the contest site (if any), participating in the contest without meeting the eligibility requirements, using any automated software or device to gain an advantage during the contest, use of the contest beyond the defined rules of the contest, attempting to disable or overwhelm any of the Organiser’s websites or the contest site (if any), attempting to disrupt any portion of the contest, including but not limited to, allowing somebody else to use your personal information, or tampering with the entry process.
18.4 Modification of these terms and conditions, etc. The Organiser may modify these terms and conditions and/or withdraw or terminate the contest at any time without giving any reason or prior notice. In such event, the Organiser shall have no liability to any party.
18.5 If for any reason this contest is not capable of running as planned, including due to infection by computer virus, bugs, technical failures or any other causes beyond the control of the Organiser, then the Organiser reserves the right to discontinue the contest where it will corrupt or affect the administration security, fairness or integrity or proper conduct of this promotion. The Organiser further reserves the right in its sole discretion to disqualify any individual who tampers, engages in fraudulent activity or other unauthorised intervention with the entry process.
19.1 The contest shall be governed by and interpreted in accordance with the laws of New South Wales, Australia. The contest is void where prohibited or restricted by law, and is subject to all applicable laws.
20. Drink responsibly
20.1 The Organiser encourages consumers to enjoy alcohol responsibly. Legal aged consumers are advised to consider the safe drinking levels recommended in the National Health and Medical Research Council Australian Guidelines to Reduce Health Risks from Drinking Alcohol.
